These Terms of Service ("Terms") govern your use of the NavView mobile application ("App") provided by Motorwise.io ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using NavView, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to be bound by these Terms and our Privacy Policy.

2. Important Safety Disclaimer

NavView is an aid to navigation only. It is not a substitute for official nautical charts, proper navigational equipment, sound seamanship, or good judgement.

• Always carry and consult up-to-date official charts and publications as required by maritime regulations.
• Electronic charts may contain errors or omissions. Cross-check positions with independent sources.
• Do not rely solely on NavView for collision avoidance, anchoring decisions, or passage planning.
• The skipper is responsible for the safe navigation of the vessel at all times.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable licence to use NavView for personal, non-commercial navigational purposes on devices you own or control, subject to these Terms.

4. Restrictions

You agree not to:

• Reverse-engineer, decompile, or disassemble the App
• Redistribute, sublicense, or resell the App or its data
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices or labels

5. Chart Data and Basemap

NavView includes a built-in world basemap derived from public sources including Natural Earth, GSHHG, GEBCO, and — for harbour-zoom detail — OpenStreetMap coastline data (ODbL). The basemap is provided as-is and is not a substitute for official nautical charts.

Additional electronic navigational charts (ENC / S-57) are available through the in-app chart store. These charts are sourced from third-party hydrographic services and are provided as-is. We do not guarantee the accuracy, completeness, or currency of any chart or basemap data. You are responsible for cross-checking information against authoritative sources before relying on it for navigation.

6. Pricing and In-App Purchases

The NavView app is free to download. Optional chart packs are available for purchase through the in-app chart store using Google Play Billing. Prices are displayed before purchase and are subject to change. Chart purchases are tied to your Google Play account and may be restorable across devices signed into the same account.

7. Limitation of Liability

To the maximum extent permitted by law, Motorwise.io and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Navigation errors or grounding
• Loss of data or equipment
• Personal injury or property damage
• Reliance on anchor watch or alarm features

Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim. Because the App is currently distributed free of charge, this amount is zero.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnification

You agree to indemnify and hold harmless Motorwise.io from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time if you breach these Terms. Upon termination, your licence to use the App ceases immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or this page. Your continued use of the App after changes constitutes acceptance.
